Terms of Use

§ 1 - Definitions

Użyte w Regulaminie pojęcia oznaczają:

  1. Vendor - the entity that administrates the online shop as well as the party of a legally binding contract with the Client that accesses the online shop. It also means the administrator of personal data in compliance with art. 7 par. 4 of Personal Data Protection Directive from 29.08.1997 (Journal of Laws 2002 No. 101, item 926, as amended) that means that Enliven Art Ltd., headquartered in Gdynia, Poland, Lukrecjowa 43 B/1 St., NIP 9581663384, enlisted in KRS (Register of Companies) under no 0000468631 governed by Regional Court of Gdansk, VIII Economic Department.
  2. Client – a natural person, a corporate personality or an organizational entity not having a corporate personality that gains legal qualification and that purchases a product from the online shop.
  3. Civil Codex Act from 23.04.1964, Civil Codex (Journal of Laws No. 16, item 93, as amended).
  4. Terms of Use – the Terms of Use, the online shop that offers products via the internet.
  5. Online shop – online service accessible at www. by means of which a Client may purchase products. 
  6. Product – products offered via the online shop.
  7. Contract – a contract as defined by Civil Codex concluded between Vendor and Client by means of the online shop.
  8. Act on Specific Conditions of Consumer Sale – Act from 27.07.2002 on specific conditions of consumer sale and amendment of Civil Codex (Journal of Laws No. 141, item 1176, as amended).
  9. Act on offering online services – Act from 18.07.2002 on offering online services (Journal of Laws No. 144, item 1204, as amended).
  10. Order – the declaration of Client’s will to conclude a sale agreement in which the amount and characteristics of a product or products is specified.


§ 2 - General Terms

  1. These Terms of Use govern the principles of access to the online shop available at
  2. These Terms of Use are in concord with the definition of Terms OfUse as in art. 8 of the Act on Online Services.
  3. These Terms of Use specify as follows:
    1. The principles of registration and access to the account within the online shop;
    2. Conditions and principles of a product purchase/reservation from the online shop;
    3. The conditions and principles of placing online orders from the online shop;
    4. The principles of concluding sale contracts by means of services offered by the online shop.
  4. Using the online shop is possible if the following conditions are met by the system the Client makes use of: a. Internet Explorer 8 version or newer b. Google Chrome 25 version or newer c. Mozilla Firefox 20 version or newer 2.4. In order to get access to the online shop Client should get access to a computer or any other device with the internet access.
  5. Due to binding law Enliven Art may restrict permission to use the site and services offered via the online shop for persons under the age of 18. In such a case a Client will be informed.
  6. Clients may get access to these Terms of Use at any time via reference on the main page (Home) of, download and print them.
  7. Information concerning our products and their descriptions, technical and utility parameters as well as prices constitute an invite for concluding a contract as regarded by article 71 of Civil Codex.


§ 3 - Using the online shop

  1. In order to access and use the online shop one has to register or fulfill a form upon purchase.
  2. Registration means the fulfillment of a form from the site of the online shop and accepting it.
  3. By accessing or using the online shop you are agreeing to the Terms of Use and sharing your personal data if required.
  4. In order to guarantee the safety of communication and data in connection with services offered by the online shop, Vendor takes upon himself the obligation to take adequate steps in order to prevent the danger of this data to be modified or uploaded by unjustified parties.
  5. The Client is obliged:
    1. Not to provide content that is prohibited by law e.g. promote violence, infringe personal belongings and other rights of third parties,
    2. To use the online shop in a way that does not disrupt its functioning esp. by using improper software or devices,
    3. Not to take activities like: sending or placing spams in the online shop,
    4. Make use of the online shop in a way that does not cause inconvenience to other Clients or,
    5. All content of the online shop is intended for personal use only,
    6. To use the online shop in compliance with law applicable in Poland, these Terms of Use as well as general principles of using the internet.


§ 4 - Procedure of Purchase Contract Conclusion

  1. In order to conclude a purchase contract via the online shop one has to access website, choose a product and download it following communications received and information from the site.
  2. The choice of products takes place once they are added to the cart.
  3. Until the button ORDER is pressed the Client may modify one’s data as well as one’s choice of products. In order to do so, one has to follow communications as well as information from the website.
  4. Once all data necessary for placing an order is provided, the summary of purchase appears on the screen. This summary will include the following information:
    1. order/ product ordered,
    2. individual price of the product purchased and the total sum for products purchased including shipment and any other costs, if applicable
    3. the method of payment
    4. selected method of shipment
    5. time of shipment
  5. In order to place an order one has to agree with the Terms of Use and Conditions of the online shop, accept its Terms of Use, provide personal data marked as obligatory and press the button - ORDER.
  6. By making an order one declares the wish to conclude a purchase contract with in compliance with these Terms of Use.
  7. After placing an order the Client will receive an email with the confirmation of the Order.
  8. The conclusion of the contract is due upon the reception of confirmation by the Client.
  9. Purchase agreement is concluded in Polish language and its content is compliant with these Terms of Use.


§ 5

  1. The shipment of products is not restricted to the area of Poland and it happens via electronic way, a Client receives a Product to one’s electronic address (email) and/or mobile device.
  2. The completion of shipment is due within 7 days from the date of the Contract.
  3. Clients may access these Terms of Use at any time via reference on the main site of Clients may download as well as print these Terms of Use. The confirmation of  vital standings of a Purchase Contract is realized by means of sending an invoice or any other document to a Client’s email.


§ 6

  1. Prices are in Polish Zloty (PLN) and they include VAT (rate included), duty as well as other components.
  2. Payment may be realized by the following means of payment:
    1. bank transfer, from Client’s electronic bank account to the bank account of Vendor as shown in processing;
    2. electronic transfer (e-transfer/direct payment) eTransfers - a Client of the online shop can choose to pay with an eTransfers from his online bank account, at which moment he is redirected to his bank’s internet service. After logging in, the customer is presented with a pre-filled money transfer form with the correct amount due and recipient data. All the customer has to do is accept the transfer, after which the transaction is confirmed and the customer is redirected back to the internet store.

  3. Vendor restricts the right to offer other forms of payment from those enlisted in point 6.2, upon individual request of a Client.
  4. In case of some Products, Vendor restricts the right to limit some of payment settlings.

§ 7 -  Contract termination

  1. Taking into consideration the character of Products offered by the online shop and the lack of possibility of its refund in conformity with article 10 par.3 p.5 Act from 2.03.2000 on Consumers’ Selected Rights Protection and responsibility for harm caused by the unsecured product (Journal of Laws 2000 No. 22, item 271 as amended), the right to withdraw from the contract concluded remotely is not applicable.


§ 8 - Idemnification

  1. Vendor is responsible against the Client being a Consumer as defined in article 22 of Civil Codex  for default of the product purchased (within the scope) as defined by Act on Specific Conditions for Consumer Purchase.
  2. Complaints should be sent to Enliven Art headquarters at or in writing at, Lukrecjowa 43B/1, 81-589, Gdynia.


§ 9 - Indemnification in the scope of offering online services

  1. Vendor takes steps in order to guarantee proper functioning of the online shop taking into consideration the status of actual technical knowledge. Vendor takes upon himself the obligation to remove all defects reported by Clients.
  2. Client is obliged to report to the Vendor all irregularities or malfunctioning of the site or brakes in the functioning of the online shop’s service.
  3. Malfunctioning of the online shop may be reported at or in writing at, Lukrecjowa 43B/1, 81-589, Gdynia or by email at or via a contact form on our site.
  4. In an indemnification form a client is requested to write one’s name and surname, address for correspondence as well as the date and the type of error/malfunctioning that took place.
  5. Vendor takes upon himself the obligation to respond to all requests at the latest 14 days after the receipt of a request or at least to contact a Client and inform him when a given request will be attended to.
  6. Vendor cannot guarantee a constant running of the service of the onlineshop and does not take upon himself the responsibility for damages or loss opportunity that may result from the use or the inability to use of Enlivenart online shop.


§ 10 - Safety Policy and use of your data

  1. In accordance with Act from 29.08.1997on Consumer Rights Protection (Journal of Laws 1997 No. 133, item 883, as amended) Vendor secures personal data provided as a result of running commercial operation and the realization of Clients’ orders.
  2. Vendor ensures that Clients’ personal data will be processed only for the purpose of order realization and marketing purposes of the Vendor.
  3. In compliance with standings articulated in Act from 29.08.1997 on Personal Data Protection (Journal of Laws 2002 No. 101, item 926, as amended), Client has the right to request an update or changing of personal data, permanent or terminated stoppage of their processing or their deletion if data are incomplete, inaccurate, not valid or if they were obtained by breach of  law. Client has the right to restrict processing of one’s personal data by providing Vendor with a request in writing. Vendor will not share either Clients’ personal data or information concerning Clients’ purchases.


§ 11 - Miscellaneous

  1. Settlement of any disputes arising between the Vendor and the Client who is a Consumer, shall be subject to the decision of proper courts in accordance with the relevant provisions of the Civil Code.
  2. Settlement of any disputes arising between and the Client who is not a Consumer, shall be subject to the decision of a proper court within the jurisdiction of the Vendor’s headquarters.
  3. To all matters not covered by these Terms of Use provisions of common law shall apply .
